Welcome to Zorivaz. These Terms of Service govern your access to and use of our online store and the purchase of products offered through it. By visiting our store, placing an order, or using our services, you agree to these Terms of Service.

Please read these terms carefully before making a purchase.

1. General Terms and Eligibility

Zorivaz operates an online retail store offering products to customers in India.

By using our store, you confirm that you are legally capable of entering into a binding agreement under applicable Indian law. If you are not legally competent to enter into a contract, you may use our store only with the involvement and permission of a parent or legal guardian, where permitted by law.

You agree to use our store only for lawful purposes and in accordance with these terms.

We reserve the right to update or modify these terms when necessary. Changes will be published on this page with an updated “Last updated” date. Changes will not remove rights that customers have under applicable law.

2. Account Terms

Some features of our store may require you to provide personal information or create an account.

You agree to:

Provide accurate and complete information when placing an order or creating an account.
Keep your account information up to date.
Protect your login credentials and notify us if you suspect unauthorised access.
Avoid creating accounts using false identities or another person's information without permission.

You are responsible for activity carried out through your account to the extent permitted by applicable law.

We may suspend or restrict access to an account if we reasonably believe it is being used fraudulently, unlawfully, or in violation of these terms. We will not use this right to avoid our legal obligations to customers.

3. Products and Product Descriptions

We make reasonable efforts to display product descriptions, photographs, features, specifications, colours, and other details accurately.

However:

Actual colours and appearance may vary depending on your device and display settings.
Product packaging or minor design details may change where permitted and without materially changing the product.
Availability may vary, and certain products may become unavailable.
Product images may be illustrative where this is clearly indicated.

We do not guarantee that every display or description will be entirely free of errors. If a product is materially different from its description, defective, damaged, counterfeit where authenticity was represented, or otherwise fails to meet applicable legal requirements, your rights under Indian law remain unaffected.

Nothing in these terms excludes statutory consumer rights.

4. Pricing and Payment

All prices will be displayed in Indian Rupees (INR), unless stated otherwise. Applicable taxes, shipping charges, discounts, and other costs will be disclosed during checkout as required by law.

We make reasonable efforts to ensure that prices are accurate. If a genuine pricing or listing error occurs, we may contact you to explain the issue and offer an appropriate resolution before proceeding with the order. We will not use pricing errors as a reason to disregard applicable consumer-protection obligations.

We accept payments through the payment methods made available at checkout. Razorpay is our payment service provider for processing supported transactions.

By submitting payment information, you confirm that you are authorised to use the selected payment method. Payment authorisation, verification, and processing may be handled by Razorpay and the relevant financial institution.

An order may be placed on hold if payment is unsuccessful, remains unverified, or is flagged for a legitimate security review. If payment has been collected for an order that we do not accept or cannot fulfil, we will arrange the appropriate refund in accordance with applicable law.

5. Order Placement and Acceptance

Placing an order constitutes an offer to purchase the selected products.

After you submit an order, you may receive an order confirmation or acknowledgement. This acknowledgement confirms receipt of your order but does not necessarily mean that the order has been finally accepted.

Order acceptance may depend on payment verification, product availability, delivery details, and other legitimate fulfilment checks.

We may decline or cancel an order where reasonably necessary, including where:

A product is unavailable.
Payment cannot be verified or completed.
The order contains a genuine pricing or listing error.
We reasonably suspect fraud or unauthorised activity.
Delivery to the provided location is not possible.

If we cancel an order after receiving payment, we will initiate an appropriate refund in accordance with applicable law. We will communicate material cancellation information to the customer.

We will not cancel confirmed orders arbitrarily or misrepresent product availability.

6. Shipping and Delivery

We aim to process and dispatch orders within the timeframes communicated on our store or during checkout.

Delivery times are estimates unless expressly stated otherwise. Actual delivery may be affected by the delivery location, courier operations, weather, public holidays, service interruptions, or other circumstances beyond our reasonable control.

Customers are responsible for providing accurate shipping details and a reachable contact number. If delivery fails because of incorrect details, repeated unsuccessful delivery attempts, or the recipient being unavailable, the courier may return the parcel or attempt redelivery.

If an order is delayed, lost, damaged in transit, or not delivered as promised, please contact us at shopzorivaz@gmail.com. We will review the issue and work toward an appropriate resolution.

Nothing in this section removes any obligation or consumer right imposed by applicable law.

7. Returns, Replacements and Refunds

Our returns, replacements, and refunds are handled in accordance with the return policy displayed on our store and applicable Indian consumer-protection laws.

Depending on the circumstances and applicable policy, a return, replacement, or refund may be available where:

The product arrives damaged or defective.
The product received is incorrect or materially different from its description.
The order is not delivered as required.
A return or cancellation is otherwise permitted under our published policy or applicable law.

Returned products may need to be unused, securely packed, and accompanied by their original accessories or packaging where reasonably required by the applicable return policy. These conditions will not override rights relating to defective, incorrect, misdescribed, or otherwise legally returnable products.

Refunds for eligible orders will generally be processed through the original payment method where feasible. The time taken for the refunded amount to appear in your account may depend on Razorpay, your bank, or your payment provider.

Any applicable return shipping charges, exclusions, and product-specific conditions will be communicated through the relevant policy. We will not apply a blanket exclusion that unlawfully removes a customer's statutory rights.

8. Cancellations

You may request cancellation by contacting us as soon as possible. Whether an order can be cancelled may depend on whether it has already been processed, dispatched, or delivered, as well as the applicable law and our published policies.

If an order is cancelled by us after payment has been collected, we will initiate the appropriate refund in accordance with applicable law.

Any cancellation charges, if applicable, will be disclosed and applied only where permitted by law. We will not impose a cancellation charge on a customer in circumstances where such a charge is prohibited by applicable consumer-protection rules.

9. Prohibited Uses

You agree not to use our store to:

Violate any applicable law or regulation.
Submit false, misleading, fraudulent, or unauthorised information.
Interfere with the security, functionality, or operation of the store.
Attempt unauthorised access to our systems, accounts, or data.
Introduce malicious code or engage in activities that could disrupt our services.
Copy, reproduce, distribute, or commercially exploit store content without permission, except where permitted by law.
Use automated systems to place fraudulent orders or abuse store features.
Infringe the intellectual property, privacy, or other rights of Zorivaz or any third party.

We may investigate suspected misuse and take reasonable action, including restricting access or cancelling fraudulent transactions, subject to applicable law.

10. Intellectual Property

The Zorivaz name, branding, logos, website content, text, graphics, and other materials may be protected by applicable intellectual property laws.

You may access and use our store for personal, lawful shopping purposes. You may not reproduce, modify, distribute, or commercially exploit our content without our prior permission, except where permitted by law.

Product names, logos, and trademarks belonging to third parties remain the property of their respective owners.

11. Third-Party Services

Our store may use third-party services, including Shopify for e-commerce hosting, Razorpay for payment processing, and courier or logistics partners for delivery.

These services may be governed by their own terms and privacy policies. Zorivaz is not responsible for the independent operation of third-party websites or services, except to the extent responsibility is imposed on us by applicable law.

12. Privacy

Your use of our store is also subject to our Privacy Policy, which explains how we collect, use, store, and share personal information.

By using our store, you acknowledge that you have had the opportunity to review that policy. Any consent required for processing personal information must be obtained in accordance with applicable law.

13. Disclaimer and Limitation of Liability

We make reasonable efforts to keep our store available, secure, and accurate. However, we do not guarantee uninterrupted access or that every technical issue, error, or service interruption can be prevented.

To the maximum extent permitted by applicable law, Zorivaz will not be liable for indirect or consequential losses arising from the use of our store where such exclusion is legally permitted.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under Indian law, including applicable consumer-protection rights, liability arising from fraud or wilful misconduct where legally applicable, or remedies available for defective, misdescribed, or undelivered products.

Where liability can lawfully be limited, any limitation will be applied only to the extent permitted by law and will not be used to avoid obligations that apply to Zorivaz as a seller.

14. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims directly arising from your unlawful misuse of our store, fraud, or deliberate infringement of third-party rights.

This section does not require you to indemnify Zorivaz for losses caused by our own unlawful conduct or remove any rights you have under applicable law.

15. Force Majeure

We will not be considered in breach of these terms solely because performance is delayed by circumstances beyond our reasonable control, such as natural disasters, widespread network failures, transport disruptions, government restrictions, or other extraordinary events.

We will take reasonable steps to minimise disruption and communicate material delays where appropriate. This section does not remove any refund or other obligation that remains applicable under law.

16. Governing Law and Indian Jurisdiction

These Terms of Service are governed by the laws of India.

Any dispute arising from the use of our store or a purchase from Zorivaz will be handled by the courts or consumer dispute-resolution bodies that have jurisdiction under applicable Indian law.

Nothing in these terms prevents a consumer from approaching a competent consumer commission or other authority where permitted by law. Nothing in this section is intended to exclude jurisdiction that cannot legally be excluded.

17. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
